This Privacy Policy (hereinafter referred to as the “Policy”) regulates relations in the field of protection of personal data of visitors to the website https://www.patriotua.org.ua (hereinafter referred to as the “website”), which belongs to the PUBLIC ORGANIZATION All-Ukrainian association “Patriot” (EDRPOU code 39251370), registered in accordance with the current legislation of Ukraine (hereinafter referred to as “GO”).

1. TERMS
1.1. In this Policy, the following terms are used:

personal data base – a named set of organized personal data in electronic form and/or in the form of personal data files;
consent of the subject of personal data – a voluntary expression of the will of a natural person (provided that he is informed) regarding the granting of permission for the processing of his personal data in accordance with the formulated purpose of their processing, expressed in a form that makes it possible to conclude that consent has been given;
processing of personal data – any action or set of actions, such as collection, registration, accumulation, storage, adaptation, change, renewal, use and distribution (distribution, realization, transfer), depersonalization, destruction of personal data, including using information (automated) systems;
personal data – information or a set of information about a natural person who is identified or can be specifically identified;
subject of personal data – a natural person whose personal data is processed;
third party – any person, with the exception of the subject of personal data, the owner or administrator of personal data;
cookies are small text files that are stored in the device’s browser (computer, mobile phone, etc.) after visiting a website and that the website transmits to the browser. You can learn more about cookies at the link: https://allaboutcookies.org/.

All other terms in the Policy are used in the meaning defined by the current legislation of Ukraine, including international legal acts ratified in Ukraine.

1.2. This Policy is designed to inform personal data subjects about the procedure for processing their personal data when visiting/using the website, as well as to ensure the protection of their personal data during such processing.

1.3. This Policy, as well as the activities of the Public Association related to the collection, processing, storage and other lawful actions regarding personal data, are regulated by:

  • Constitution of Ukraine;
  • According to the Law of Ukraine “On Personal Data Protection” dated June 1, 2010 No. 2287-VI;
  • other current regulatory and legal acts of Ukraine, which regulate the issue of personal data protection;
  • international legal acts ratified in Ukraine.

The law (including international), national and international legal acts governing the protection of personal data of residents of such countries also applies to legal relations that arise in NGOs in connection with the processing of personal data of residents of foreign jurisdictions.

1.4. The owner of the personal data processed in connection with the visit/use of website options is the NGO.

The NGO has the right to fully or partially entrust the processing of personal data to third parties on the basis of a contract concluded in accordance with the requirements of current legislation.

1.5. An individual is a subject of personal data under this Policy if he is a visitor to the website, including if he uses any options available on the website.

1.6. NGO guarantees that:

  • observes good practice and regulatory requirements for the protection of personal data;
  • protects the rights of personal data subjects;
  • prevents the risk of breaching the security of personal data processing.

1.7. The purpose of processing personal data obtained in the course of website operation is to carry out the statutory activities of the NGO.

1.8. Posting this Policy using the link specified in clause 4.1. of this Policy, is a notice to the subjects of personal data about the Owner, the composition and content of personal data collected in connection with visiting/using the website, about the rights of such subjects, the purpose of collecting their personal data and third parties who such personal data may be transferred.

  1. PROCESSING OF PERSONAL DATA

2.1. The NGO may collect and process the following information about you:

  • Information you provide to NGOs: This is information about you that you provide by: using the website and website options, signing up for email updates, making charitable contributions (donations) using website options, communications with NGOs through the options available on the website, etc.
  • Information about you collected by the website and other systems:

1) if you visit the website, third parties may collect certain information about you and your visit, such as the type and version of your browser, as well as the pages on the website you visit, the Internet Protocol (IP) address;

2) The website may also download cookies to your device;

3) if you contact the employees of the NGO using the website or other means of electronic communication.

  • Information that third parties collect about you on the website through actions: this is information about you that you provide to third parties (for example, Facebook, Google, Twitter) using the social network sharing options available on the web -site, when moving from one page to another or by viewing materials that have links (opening) to other platforms (websites).

2.2. How GO processes your personal data depends on how you use and interact with the website. Some of the information may be provided directly by you while using the website or in another way; other information may be collected and processed independently by the GO using automated technologies used on the website.

2.3. Legal basis for data processing: when visiting the website, the NGO processes your personal data if:

1) the NGO has received your consent for such processing;

2) your personal data is necessary for the NGO to conclude and execute a transaction with you or to carry out measures preceding the conclusion of a transaction;

3) in cases where the NGO has a legitimate interest in processing your personal data, and this legitimate interest does not prevail over your interests in data protection or your fundamental rights and freedoms, and;

4) in other cases determined by current legislation. In some cases, the NGO may have a legal obligation to process your personal data or will process your personal data to establish, exercise or defend legal claims.

2.4. Automated processing mechanisms: NGOs and third parties may use automated information processing technologies to process information in some sections of the website. NGO uses cookies to store content and settings, which allows NGO to process standard information that your browser sends to certain websites you visit, such as your IP address, browser type and language, and the site you came from , the pages you visit and the links you click on the website. The availability of such information helps the CSO to improve the website.

2.5. NGO may use your personal data only for the purpose and for the purposes defined by this Policy and current legislation, in particular (but not limited to):

1) for the purpose of processing your request (appeal) to the NGO made using the website;

2) in order to ensure that you provide charitable assistance (donations) using the options available on the website;

3) in order to implement other statutory goals of the NGO in the manner determined by current legislation.

2.6. GO may accumulate personal data processed during your visit/use of the website, including by entering this data into a personal database. The storage of your personal data is carried out in compliance with the requirements of current legislation in the field of personal data.

2.7. The distribution of your personal data is carried out exclusively with your consent or in the cases specified by this Policy and current legislation.

2.8. Your personal data is subject to deletion or destruction in case of:

  • end of the 2-year period of their storage or another period determined by current legislation;
  • termination of the legal relationship between the subject of personal data and the NGO, if otherwise provided by legislation;
  • in other cases determined by current legislation in the field of personal data protection.

 

  1. RIGHTS OF PERSONAL DATA SUBJECTS.

3.1. When visiting/using the website, you have the right to:

  • receive from the NGO information, not defined by this Policy, regarding the processing, terms of providing access to your personal data, or give an appropriate mandate regarding the receipt of this information by persons authorized by you, except for cases specified by law;
  • for free access to your personal data;
  • receive a response to the request regarding the processing of your personal data in the manner and within the time limit specified by the current legislation;
  • present a reasoned claim with an objection to the processing of your personal data, or regarding the change or destruction of your personal data, if such data is processed illegally or is unreliable;
  • to protect your personal data from illegal processing and accidental loss, destruction, damage in connection with intentional concealment, failure to provide or untimely provision of them, as well as protection from providing information that is unreliable or dishonors honor, dignity and business the reputation of an individual;
  • revoke your consent to the processing of personal data;

and also exercise other rights defined by current legislation in the field of personal data protection.

  1. CHANGES TO PRIVACY POLICY

The NGO does not process personal data about racial or ethnic origin, political, religious beliefs, membership in political parties and trade unions, criminal convictions, as well as data related to health, sexual life, biometric or genetic data, except cases specified by law.

3.2. You have the right to address questions related to the collection, use, storage and other processing of your personal data to the Commissioner of the VRU for Human Rights, who can be contacted via the e-mail address hotline@ombudsman.gov.ua.
